Welcome to bitBykes!

These Terms of Service ("Terms") govern your access to and use of the bitBykes Platform (the "Service"), provided by bitBykes B.V. ("Company," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

The bitBykes Platform is a web-based application that allows users to:

  • Pair with compatible bicycle computer hardware.
  • Manage device settings.
  • Visualize activity data (graphs, metrics, and history).

2. Eligibility

By using our Service, you represent and warrant that you are at least 16 years old [Adjust age based on local laws] and have the legal capacity to enter into these Terms.

Accounts and Registration

To access full features, you must register for an account.

  • Authentication: You may sign up using a valid email and password, or via third-party authentication providers such as Google, Strava or Spotify.
  • Security: You are responsible for maintaining the confidentiality of your login credentials. You accept responsibility for all activities that occur under your account.
  • Accuracy: You agree to provide accurate and complete information, including personal metrics (e.g., weight, sex) required for accurate data analysis.

4. Safety and Hardware Use

Warning: Do not interact with this App while riding.

  • The bitBykes Platform is intended for use with a smartphone mounted to the bicycle. Please only interact with the App only when you are stationary and safe. Attempting to change settings or view data while riding a bicycle is dangerous and strictly prohibited.
  • Hardware Compatibility: We do not warrant that the Service will be compatible with all third-party bicycle computers or sensors.
  • Data Accuracy: Data provided by the Service (e.g., speed, power, heart rate) is for informational and recreational purposes only. It should not be treated as medical advice or precise scientific measurement.

5. User Data and Privacy

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy.

  • Data Stored: We store personal data such as your email, sex, and weight to calculate metrics and manage your account.
  • Storage & Encryption: All data is stored in our private cloud. We utilize encryption for data at rest and data in transit between your device and our cloud.

6. Intellectual Property

>All rights, title, and interest in and to the Service (excluding data provided by users) are and will remain the exclusive property of bitBykes B.V. and its licensors.

7. Account Termination

By You: You may delete your account at any time through the settings menu in the Service. Upon deletion, your personal data will be removed from our active systems in accordance with our data retention policy.

By Us: We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Limitation of Liability

To the maximum extent permitted by applicable law, bitBykes B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
    • Any conduct or content of any third party on the Service;
  • Any unauthorized access, use, or alteration of your transmissions or content.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
